Against Regulations of Management and Prevention Noisy Pollution, the Operating Regulation of Implementing Administrative Licensing for Shanghai Environmental Protection Bureau, the Process Regulation of Handling Administrative Licensing Affairs for Shanghai Environmental Protection Bureau, and the Provision of Approval for Night Construction in Shanghai.

Environmental enforcement mechanism has been improved. The subject and basis of law enforcement have been coordinated, along with decomposed authorities and identified responsibility. The Implication Scheme to Assess the Enforcement Performance of Environmental Agencies in Shanghai (2006) was issued to establish the performance assessment system for the environmental enforcement. Enforcement authorities were organized to undertake self-examinations and inspections, and the Enforcement Joint Conference further improved information communication and the mechanism of enforcement coordination.

Stricter punishments were executed to those environmental law violators. In 2006,environmental authorities in Shanghai set out 59,408 person-times to conduct 24,044 times on-the-spot supervision over 45,562 pollution sources. 16,701 person-times were sent out to clear up and to regularize the enterprises who violated environmental laws, including 25 violators clamped down, 37 violators required to handle their pollution on time, 261 violators fined by the amount of 10,053,200 RMB. 1367 violators got administrative punishment in 2006. The total fine amounted to 25.559 million RMB, and the levied fee for the excessive discharge of pollutants amounted to 346 million RMB.

III. Environmental Policy

Some environmental encouragement policies were still carried on, such as the transfer payment of protection activities for water resources, the subsidies for waste water treatments and pipe network construction in suburb areas, the subsidies for the treatments of the discharge from industrial estates and clean energy developments of coal-burning furnaces,and the subsidies for the installation of on-line monitoring facilities. Furthermore, the Policy of Operational Cost Subsidy for Waste Water Treatment at the Water-source Conservation Zone along the Upper Stream of the Huangpu River has been launched in 2006. To accelerate the progress of desulphurization of coal-burning power plants, Shanghai Development and Reform Commission promulgated some preferential policies, for example,the old plants with desulphurization could sell the electricity to the grid at the same price as the new plants with an environmental discount, and the plants with desulphurization facilities could be given the priority to get access of the electricity grid. Moreover, Shanghai Environmental Protection Bureau set up the subsidy policy for the flue gas desulphurization projects. 9 administrative authorities including Shanghai Economic Commission and Shanghai Environmental Protection Bureau jointly instituted the Integrated Policy to Eliminate Disadvantaged Enterprises.
