(2)Environmental Legislation

The municipal government amended the Regulation of Environmental Protection in Shanghai, and completed the draft of Provisions on Medical Waste Pollution Prevention and Control in Shanghai. From 2001 to 2005, there were one local environmental ordinance established and one amended, seven local environmental regulations or rules enacted.

Joint environmental enforcement mechanism at both municipal and district levels has been improved though quantitative assessment regarding law enforcement and identification of relevant provisions.

Shanghai Environmental Protection Bureau attached great importance to the Administrative Permit Law. Associated with the Municipal Supervision Committee, Municipal Legislation Office and other authorities, SEPB conducted inspections on enforcement performance of Administrative Permit Law relating to environmental authorities.

Environmental law violators got stricter punishment. In 2005, environmental authorities at all levels in Shanghai set out 50,339 person-times to conduct 19,209 times on–the-spot supervision over 41,347 pollution sources. During the act of clearing up the enterprises violating environmental laws, 12 violators were clamped down, 160 were required to be corrected on time, 342 were fined by the amount of 6.81 million RMB. The total levies on discharge exceeding standard limits amounted to 319.63 million RMB and 1560 violators got administrative punishment in 2005.
